1. GENERAL INFORMATION.

General conditions of the sole proprietorship PRUDHAM GERARD JEAN DANIEL EI (operating under the name of EuroAirport Shuttle)
Our Company has set out below the terms and conditions (hereinafter referred to as the “General Terms and Conditions of Sale”, “Terms and Conditions”) which allow travellers (hereinafter referred to as the “Customers”, “Passengers”, “you”) to book any service related to travel, such as ground passenger transport service (hereinafter referred to as “Transfer”) using www.euroairportshutlle.fr (hereinafter referred to as the “Digital Platform”, “Website”)
A passenger, who wants to use our services, must accept our Terms and Conditions, otherwise we cannot work together.
These Terms and Conditions are subject to change without notice.
We, PRUDHAN GERARD JEAN DANIEL EI, a company registered in France with the company number SIRET 51238816600039, whose registered office address is 12 Rue Vivienne Lot 3 75002 PARIS France, operating under the name of EuroAirport Shuttleact solely as a platform for connecting passengers with a partner carrier.
By making a booking with us, the first person named on the booking agrees, on behalf of all persons named on the booking, that they will:
1. read these Terms and Conditions of our digital platform and agrees to be bound by them;
2. consents to our use of personal data in accordance with our privacy policy and is authorised, on behalf of all persons named on the booking, to disclose their personal data to us.
3. is over 18 years of age;
4. accepts financial responsibility for payment of the booking on behalf of all persons named on the booking.

2. WHO WE ARE

We are a ground passenger transport company, specialised in airport transport, since 2009, our transport licence number is EVTC 068170002.
We have covered more than 1,000,000 kilometres safely, day and night, in all weather conditions, and we operate to and from the following airports: EuroAirport Basel-Mulhouse-Freiburg, Zurich, Geneva, Frankfurt, Stuttgart, Baden Baden, Milan.
In 2023, we have decided to create our digital platform to connect a partner carrier with a passenger departing from or arriving at Paris Roissy CDG, Paris Orly and Nice airports.
In order to provide our services, we work with various partner carriers, who provide services for the ground transport of people. All of these partner carriers have the capacity to offer excellent ground passenger transport services, having all the relevant licences and permits required by European legislation for this activity.

3. DEFINITION OF OUR SERVICE

The passenger chooses the airport of departure or arrival, then the destination address, then the calculator will issue an online quote, which includes the amount of the platform’s fees and the amount of the carrier’s fees. When the passenger accepts this quote, the platform will publish a transport request, which will be sent to all our partner carriers registered at this airport.
As soon as a carrier accepts this transport request, only the amount of the platform’s fees will be automatically debited to the passenger’s credit card by the STRIPE payment gateway, confirming the transfer reservation to the passenger by sending him/her a reservation form by email.
The balance of the quote, due, corresponds to the amount of the transport, to be paid directly to the carrier, by credit card, or in cash, on the day of the transfer, on arrival at the destination.

5.VEHICLE DESCRIPTIONS AND STANDARDS.

All vehicle descriptions are those provided by the partner carriers. These are intended to give a guide to the equipment you should have during your transport. Standards and ratings may vary from country to country. We cannot guarantee the accuracy of the information given. The images of the vehicle make and model shown on the quotation page are for illustrative purposes only and neither we nor the carrier can guarantee that these exact vehicles will be provided for the passenger’s transfer. With regard to vehicle categories, a passenger will never be provided with a vehicle of a lower category than the one selected at the time of booking.
The distance and travel time provided by our online quote calculator is for planning purposes only. It does not take into account roadworks, traffic delays, adverse weather conditions or any other event which may cause actual conditions to differ from the published information and you should plan your travel time accordingly.

6. OUR RESPONSIBILITY FOR YOUR BOOKING.

Your transfer is made with a partner carrier, not with us. As an intermediary platform, we do not accept any responsibility for your transfer. However, in the event that we are found to be liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of the commission we earn on your booking.

7. RESPONSIBILITIES OF THE PASSENGER(S)

The passenger must be of legal age (18 years) to book a transfer on our platform. Please ensure that any passenger, who is under the legal age (under 18, also known as a “child/teenager”) must travel with adults. Any booking made by a child/adolescent will be cancelled.
All information given at the time of booking must be true and accurate.
The passenger must inform our platform of any inappropriate behaviour by the partner carrier, and any inaccuracies discovered, on the booking form.
The passenger must use his/her own debit/credit card to make payments on our platform.
Passengers must maintain appropriate conduct when using our services.
Passengers are strictly forbidden to use the content, data and other details belonging to our digital platform for commercial purposes.

8. PAYMENT/REFUND POLICY

The external payment gateway, STRIPE, 3180. 18 Th Street.CA 94110 San Francisco USA, is PCI compliant and processes all credit card transactions, payments made on our digital platform.
All such transactions are not stored or processed on our servers.
Please note that the credit/debit card processing fee (from 1.4% – to 2.9%) charged by our payment processing partner Stripe.com is non-refundable, when you cancel your booking.

9. CANCELLATION AND MODIFICATION POLICY.

1. changes and cancellations by you

CANCELLATION: You may cancel at no charge, provided you cancel at least 24 hours prior to the pick-up time of the booked transfer, by contacting our platform by email, using our contact form, and quoting your booking number, not by telephone.
Cancellation requests by telephone are not accepted.
If you cancel your booking within 24 hours of pick-up, you must contact your partner carrier directly by calling the number on your booking confirmation form to advise them of your cancellation.
Please note that the credit/debit card processing fee (from 1.4% – to 2.9%) charged by our payment processing partner Stripe.com is non-refundable, when you cancel your booking.

MODIFICATIONS: You may request a change to your transfer by contacting your carrier by email, but we cannot guarantee that your carrier will be able to accommodate your change requests. In the event that the partner carrier is able to accept your changes, it is possible that the changes may result in additional transportation costs, in which case the carrier will charge you for the additional costs.

2.Modifications and cancellations by your Partner Carrier.

MODIFICATIONS The Carrier will contact you as soon as possible by email to inform you that they need to make a major change to your confirmed transfer or cancel it. If you cannot accept the change proposed by the carrier, you may request the cancellation of the transfer and the platform will refund your prepayment according to our payment/refund policy.
CANCELLATION If your carrier cancels your confirmed transfer, the platform will refund your prepayment according to our payment/repayment policy.

10. YOUR PICK-UP.

For departures from an airport, port or train station, the waiting time for your carrier is 60 minutes, from the time of arrival of your plane, boat or train. If you are delayed, for various reasons, inform your carrier, by contacting him, by SMS, or by a phone call.
For all other departure points, the waiting time for your carrier is 15 minutes.
If the waiting time exceeds the mentioned limits, your carrier may apply additional charges.

11. YOUR FLIGHT.

Your flight arrives ahead of schedule.
If your flight is early, you must wait for your carrier at the meeting point indicated on your booking form until the scheduled pick-up time.

If your flight is late, you must wait for your carrier at the meeting point mentioned on your booking form until the scheduled pick-up time.
If your flight is delayed, there are two possible situations:

– Normal delay. It is a delay of 5 to 60 minutes maximum, your carrier has foreseen this situation in its planning, it will wait for you.
– Abnormal delay. This is a delay of several hours, in which case you should contact your carrier as soon as possible to find out if they will be able to reschedule your pick-up according to their daily schedule of land transport. In the event that they are unable to confirm your new pick-up, you will have to contact a new local carrier to carry out your transfer.

12. COMMUNICATION.

Regarding your reservation and its possible cancellation, you should contact the EuroAirport Shuttle platform directly, either from the website, using the contact form, mentioning your reservation number, or by sending an email to booking@euroairportshuttle.fr, always mentioning your reservation number.

As far as YOUR TRANSFER is concerned, you will contact your partner carrier directly by email the days before your trip, or by SMS or phone call on the day of your trip. The contact information of your carrier is mentioned on the booking confirmation form that you received by email.

13. FORCE MAJEURE

Our Company shall not be liable for any compensation or damages for any delay or failure to perform any of the terms and provisions of this Agreement arising from causes beyond its control, including, but not limited to, acts of God or public enemies, acts of civil or military authority, labour disputes, fire, riots, war or warlike conditions, embargoes, accidents of third parties on the transfer routes, epidemics, floods or other exceptionally severe weather conditions, closure or obstruction of highways, bridges, any of which has a material, substantial and adverse effect on the ability to operate in accordance with the terms of this Agreement.

14. COPYRIGHT

All content of the website, such as text, graphics, logos, icons, images, etc., is the property of our Company and is protected by French law and, therefore, the user has no rights to the platform other than those granted to him/her under these terms and conditions.

The use of our website or its contents by third parties for purposes other than booking the services provided on the website is strictly prohibited. This also includes.

Any use of our Company’s logo or resale of our website content.
Using our website and its contents, databases, source code and software for commercial purposes, except where written consent has been given by EuroAirport Shuttle.
Any modification or further publication of the content without our express consent.
Use of any “web scraping” techniques to access the content of the website
Use of any “deep linking” methods that may confuse the user, e.g. “framing” and/or those that imply unlawful or illegal exploitation of euroairportshuttle.fr content
The use of our website for illegal purposes is strictly prohibited in all circumstances.

15. TERMINATION

Our Company has the right to terminate, pause/suspend this agreement for its users without notice.
Immediate termination will be effected upon breach of the agreement.
We may pause/suspend a user’s account for maintenance/improvement of the platform for a period of time.
Any activity, including illegal actions or misuse of the platform, will result in termination of a user’s account.

16. APPLICABLE LAW AND DISPUTE RESOLUTION

These General Terms and Conditions of the EuroAirport Shuttle platform are governed by French law. The courts of Paris shall have exclusive jurisdiction in the event of disputes.
